our smoke detector went off and we discovered water leaking from it. plumber and smoke detector tech came out?

and neither found anything wrong. our smoke detector has gone off a few times since. should we be worried? could there be an electrical shortage?

Upstairs neighbour water leak into my property?

I live in a townhouse, there is another townhouse on top of mine. There is a leak in my ceiling. I brought a team of leak detectors in and they tested my pipes with gas and found that the pressure stayed constant – ruling out a fault in my pipes. They also found that there are no pipes in that area where the leak is (used a "metal" detecting device) – obviously again ruling out a fault in my pipes. The ceiling is below a shower in the townhouse upstairs and the plumbers suspect that the shower waste pipe is leaking there.

If the neighbours upstairs do a shoddy job of fixing the root cause and it leaks again – please advise – what recourse do I have?

How to get a home seller to make concessions after the inspection finds problems?

I put an offer in to buy a house, contingent on inspection, and the seller accepted. We had a home inspector out yesterday, which found a few problems.

Obviously the inspector is paid to find problems, and he comes back with a laundry list. Most items are negligible (no door stops, no smoke detectors, A/C beyond useful life, etc), and I’m not worried about those nor going to demand that the seller correct.

The main problems found are:

1) Non-GFCI electrical circuits in unfinished basement. Technically this is a safety concern because the cement floor is a conductor to ground, but the GFCI requirements are per 2008 revisions to the NEC. The local municipality does not require an electrical inspection, so the seller is not required to update to the new code before selling. My only worry here is that by the time I go to sell the house, the village might then require inspections, and I’ll have to update the electrical. These circuits are multi-branch run w/ a shared neutral, so it’s not so easy to install GFCI’s — a separate neutral would have to be run for each circuit, and that may or may not be easy depending on the piping in the house.

2) The 2 bathrooms both have loose toilets, and the inspector indicates that the upstairs bathroom may have rotting wood around the toilet due to bad seal and leaking water from the toilet — can’t tell for sure without tearing the tile up and looking at the floor. Could be something as simple as tightening the screws on the toilets; or it could be more major like replacing a broken closet collar and/or replacing rotting wood. THIS is what has me worried.

The seller has tried to make it very clear that he is selling "As-is." He was at the inspection and simply made comments like, "Well I hope this isn’t a deal breaker" (as in take it or leave it). We haven’t gone back at him yet with our demands or concessions, but his overall attitude seems like he won’t budge on the price or make the repairs.

I can easily break the deal over this if he won’t budge, my problem is that I don’t want to. For the price and area, this is a really good house and everything else was perfect, also considering the other houses in the area are not as well-kept and listed higher than this one.

It’s really more psychology and calling each others’ bluff, but I’m not ready to just walk away yet. I grew up and was in grade school & high school band with the seller’s son, and he remembers me from those times — kept making comments to me about how good I was and all the awards I used to win. He had 2 other offers on the house before mine. According to my agent, another offer was better than mine, but he accepted mine because he knows and respects me.

SO… any suggestions on how to get the seller to make concessions for these problems without offending him? Or I am truly in a take it or leave it position?
Thanks for the response so far and I appreciate the comments. I didn’t want to bog down the post with extra details about the listing or contract. It is/was *not* listed "As-Is". My initial contract/offer is subject to professional inspection, and can be nullified upon the finding of any defect if both parties cannot reach a resolution.

Subsequently, the seller handwrote "As-Is" (and inserted other hand-written changes) to my offer before he signed it, which legally acts as a rejection of my initial offer and a new counter-offer by him, which I have not signed off on or accepted yet. That in itself, regardless of the inspection, is why I say I can easily break the deal.
Mr. Placid — absolutely correct. There isn’t actually a valid contract right now since he penciled-in changes to my offer after I signed it. His agent simply handed me back their "acceptance" at the inspection and said, "here’s your signed copy." I didn’t pick up the changes until I got home and actually looked at it. So my option is to accept the changes and ratify it "as-is" or reject it and walk away (or counter). Granted, I’m not an attorney. My perception is that the seller and his agent are still going forward under the assumption that I’ve accepted their changes notwithstanding.

All the appliances are already included. He and his wife are moving to a smaller house, so I might see if he’s willing to leave some furniture so that I don’t have to buy all new stuff.

The inspection provision didn’t specifically require him to make repairs — just stated that if defects are found during inspection and a written agreement cannot be reach within 10 days, then the contract is voidable.

I got a bill from the water company saying I used 26,000 gallons of water last month. My normal usage is?

about 6,000 gallons. They claim they came and double checked my meter and that the reading was correct. I guy just came to my house and said that the leak detector shows no leaks and that this month I have only used 6,000, as usual. I don’t have a pool and have done nothing different. I don’t know what to do. The water company is acting as if I must have used this much watter???!!! Any ideas?

what do my rock piles indicate?

I have hundreds of acres in NYstate. I have lots of rock piles on the side of a rolling hill. Most of the these are about 300 square feet, cleary human in origion, and most rocks are larger then a human could carry comfortably. I also have half a dozen larger piles on top of the hill or more. I assumed these were framer stacked, but my metal detector indicates this likely predates farmers (Absolutly no fences found, and no metal scrap? etc). The land is too asidic for grasses, and blueberry and scrub fluffy ground cover blankets the hill. Then I noticed all the stacks on the side of the hill are where the ferns grow, and where water leaks out of the mountain, even during the dry days of july. For the record, even the old logging ruts have horse-shoe nails, etc, that get lost along the trail, so, anyplace where modern man gets involved, leaves metal scrap. On the next mountain, my neighbor found a slate indian arrowhead, which is super clean (not suprising). ?? Then I was thinking the ascidic nature of the hill has kept modern man off of this property likely ever since the indians discovered columbus. It’s just unusable for anything except hunting, logging, etc. Although the yotes and birds love it and call it home. Also note, all rockpiles from field clearning has lots of metal around the rock piles, and It’s not the place for metal detecting (too much metal junk). Any ideas?

Landlord missouri laws with fixing problems.?

I just moved into a two bedroom duplex. It is a older duplex and just looking around it looked just fine. So I moved in. . . Little did I know I have a slum lord. I’ve only lived there for FIVE DAYS, and all the window are so old the screens fell off and even the actual window part fell off. IT WAS NAILED SHUT! Also the windows have so much condensation that the window banister under the plastic has molded. The windows leak bad so bad that I have puddles on my bed. Also one of my sockets are burned out. Its a fire hazard the water is going to the socket. The socket you can tell looks like it caught fire. Under the sink there was a leak or something. Now the board under the sink is completely warped and have a bad smell and some mold has formed. When I told the landlord he said "he doesn’t have the money to put new windows in the duplex. Its your responsibility to make sure you wipe the water up from the windows condisation. All windows do that." Also it is so cold at night none of the vents even feel like anything is coming out. I’ve written all these problems down and tried to give it to the maintance guy. He says don’t worry about it your showing me what is wrong now.

The landlord is not wanting to do anything for this duplex he is a slumlord. What are some laws for landlords? There isn’t one smoke detector in my house. He refuses to fix the windows his solution is plastic. Plastic isn’t going to help the fact that the window completely is out.

Any ideas?

lawyers, eviction lawyers..or anyone with eviction knowledge..please!!!?

ok, so i moved into an apartment last year on may 25, 2009. The contract is under my husband,his grandparents, my son, and me. we payed our rent of 5 and another 5 for deposit on that same day we moved in and have paid our rent on time, it wasn’t until the end of April 2010 when someone from a mortgage company came to ask for the owner to talk about our apartments due to foreclosure. We found out that the owner hadn’t been paying the rent since October 2009, so the 2 tenants and ourselves decided we weren’t going to pay until he showed us proof he will continue paying the apartment mortgage. today two women from i don’t know where?? dropped off some packets which appeared to be lawsuits filed by the landlord, it says something about we have 3 days to pay what we owe ( 3 months worth of rent ) or vacate the premises… the thing is that my contract ended in may, and he refused to give us our deposit even if we had payed.. also he is the biggest piece of s*it landlord.. our sink doesn’t work.. and when we were paying rent he refused to fix it, the toilet leaks and is cracked, there are black fungus stains growing out of the wall, there are fire detectors that don’t work.. and he built an "illegal" room in the back that is supposed to be our garage.. the ceiling looks as it is gonna fall because of water damage… i can afford to get another place unless i get the deposit money for a down payment for another place….. i want to know what rights i have.. and what should i do???
